Please read these Terms of Service ("Terms," "Agreement") carefully before using the website located at deweyspizzas.rest (the "Site") or placing any order with Dewey's Pizza ("Company," "we," "us," or "our"). By accessing or using our Site, placing an order, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease use of our Site and services.
1. Acceptance of Terms

We reserve the right, in our sole discretion, to suspend or terminate your access to the Site and services, cancel any pending orders, and pursue all available legal remedies if you engage in any prohibited activity.

The price applicable to your order will be the price displayed at the time you place your order, provided your order is accepted and confirmed.
Delivery fees, service charges, and any other applicable fees will be clearly disclosed at checkout prior to your final confirmation of an order.
5.3 Payment Methods
We accept major payment methods as displayed on the Site at the time of checkout. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge the total amount of your order, including applicable taxes and fees, to that payment method.
All payment transactions are processed through secure, third-party payment processors. We do not store your full payment card information on our servers. You acknowledge and agree that we are not liable for any errors or failures attributable to our third-party payment processors.
5.4 Refunds and Cancellations
Due to the perishable and time-sensitive nature of food products, all sales are generally final once an order has been confirmed and preparation has begun. We will review each situation on a case-by-case basis and, at our discretion, may issue a refund, store credit, or replacement order.
Cancellation requests made before preparation has begun may be accommodated. Once an order is in preparation or out for delivery, cancellations and refunds may not be available.
5.5 Promotional Offers and Coupons
Promotional codes, coupons, and special offers are subject to their own individual terms, limitations, and expiration dates. Only one promotional code may be applied per order unless otherwise stated. We reserve the right to modify or cancel any promotional offer at any time.
6. Delivery Services
Delivery services are available within designated geographic areas. Delivery times are estimates only and may be affected by order volume, traffic conditions, weather, and other factors beyond our control. We are not liable for delays in delivery caused by circumstances outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. We shall not be liable for orders delivered to an incorrect address due to inaccurate information provided by you. If a delivery attempt is unsuccessful due to no one being present or accessible at the delivery address, you may not be entitled to a refund.
We reserve the right to use third-party delivery partners to fulfill orders. Your interaction with any third-party delivery service is subject to that party's own terms and conditions.
7. Intellectual Property Rights

The Dewey's Pizza name, logo, and all related marks, trade names, trade dress, and slogans are trademarks or registered trademarks of Dewey's Pizza. You may not use any of these marks without our prior written permission.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for the purpose of placing orders and using our services for your personal, non-commercial use. This license does not include the right to:
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or Content;
- Modify, create derivative works from, or adapt any Content;
- Use any data mining, robots, or similar data gathering or extraction tools;
- Frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information;
- Use any meta tags or hidden text utilizing our name or trademarks without express written consent.
Any unauthorized use of our intellectual property terminates the limited license granted herein and may subject you to civil and criminal penalties under applicable law.

8. Allergen and Nutritional Information

However, our food is prepared in a kitchen environment that handles common allergens including, but not limited to, wheat, gluten, dairy, eggs, tree nuts, peanuts, soy, fish, and shellfish. We cannot guarantee that any menu item is completely free from allergens or cross-contamination.

9. Disclaimer of Warranties
THE SITE AND ALL SERVICES PROVIDED BY DEWEY'S PIZZA ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEWEY'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT;
- WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
- WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY CONTENT ON THE SITE;
- WARRANTIES THAT DEFECTS OR ERRORS WILL BE CORRECTED;
- WARRANTIES REGARDING THE QUALITY, SAFETY, OR SUITABILITY OF ANY FOOD PRODUCT FOR YOUR PARTICULAR NEEDS OR PREFERENCES.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such cases, our warranties are limited to the maximum extent permitted by applicable law.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE UNITED STATES FEDERAL AND STATE LAW, IN NO EVENT SHALL DEWEY'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
- LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR ANTICIPATED SAVINGS;
- DAMAGES ARISING FROM YOUR INABILITY TO ACCESS OR USE THE SITE OR SERVICES;
- DAMAGES ARISING FROM ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREON;
- DAMAGES ARISING FROM INTERRUPTION, CESSATION, OR ALTERATION OF TRANSMISSION TO OR FROM OUR SITE;
- DAMAGES ARISING FROM ANY BUGS, VIRUSES, TROJAN HORSES, OR SIMILAR ITEMS TRANSMITTED BY THIRD PARTIES;
- DAMAGES ARISING FROM YOUR RELIANCE ON ANY CONTENT OBTAINED THROUGH THE SITE.
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100.00) OR (B) THE TOTAL AMOUNT PAID BY YOU TO DEWEY'S PIZZA IN THE THIRTY (30) DAYS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some states do not allow the limitation or exclusion of liability for certain types of damages. In such states, our liability is limited to the greatest extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Dewey's Pizza and its officers, directors, employees, agents, contractors, licensors, suppliers, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorneys' fees and court costs) arising from or related to:
- Your use of or access to the Site or services;
- Your violation of any provision of these Terms;
- Your violation of any third-party rights, including intellectual property rights, privacy rights, or proprietary rights;
- Your violation of any applicable federal, state, or local law or regulation;
- Any content you submit, post, or transmit through the Site;
- Your fraudulent, negligent, or intentionally wrongful conduct;
- Any dispute or issue between you and any third party.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. 14. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States and the laws of the state in which Dewey's Pizza is principally registered and operates, without regard to its conflict of law principles.
Subject to the dispute resolution provisions below, you agree that any legal action or proceeding relating to your access to or use of the Site or services shall be brought exclusively in the appropriate federal or state courts of competent jurisdiction in the United States. You hereby consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.
Nothing in these Terms shall limit our right to seek injunctive or other equitable relief in any court of competent jurisdiction where necessary to protect our intellectual property, confidential information, or other proprietary rights.
15. Dispute Resolution
15.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services by contacting us directly at [email protected] and providing a written description of your complaint. We will attempt to resolve your concern within thirty (30) calendar days of receipt. Most concerns can be resolved quickly and informally through this process.
15.2 Binding Arbitration
If we are unable to resolve a dispute through informal negotiation within thirty (30) days, you and Dewey's Pizza agree that any unresolved dispute, claim, or controversy (except as set forth below) shall be resolved by binding arbitration on an individual basis in accordance with the rules of the American Arbitration Association ("AAA"), including the AAA's Consumer Arbitration Rules.
The arbitration shall be conducted in English, and the arbitral award shall be in writing and shall be final and binding. Judgment upon the award may be entered in any court of competent jurisdiction. The arbitrator shall apply applicable federal and state law.
YOU AND DEWEY'S PIZZA EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action.
15.3 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration. Claims relating to intellectual property infringement, including copyright, trademark, or trade secret claims, may also be brought in a court of competent jurisdiction.
15.4 Arbitration Fees
The payment of arbitration filing fees and costs shall be governed by the AAA's Consumer Arbitration Rules. We will not seek attorneys' fees and costs in arbitration unless the arbitrator determines that your claim is frivolous or brought in bad faith.
16. Term and Termination
These Terms shall remain in full force and effect for as long as you use the Site or services, or maintain an account with us. You may terminate your use of our services at any time by discontinuing your use of the Site and, if applicable, deleting your account.
We reserve the right, at our sole discretion, to suspend or terminate your access to the Site and services, with or without notice, and without liability to you, for any reason, including but not limited to:
- Violation of these Terms;
- Fraudulent, abusive, or otherwise harmful conduct;
- Conduct that we believe creates legal liability for us or third parties;
- Extended periods of account inactivity;
- Our decision to discontinue, modify, or restructure our services.
Upon termination, your right to use the Site and services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, limitations of liability, indemnification obligations, and dispute resolution provisions.

18. Force Majeure
Dewey's Pizza shall not be liable for any failure or delay in performance under these Terms resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, fire, floods, earthquakes, power outages, government actions, labor disputes, strikes, supply chain disruptions, internet or telecommunications failures, or any other event constituting a force majeure event.
In the event of a force majeure event, our performance obligations shall be suspended for the duration of such event, and we will make commercially reasonable efforts to resume normal operations as promptly as possible.
19. Severability
If any provision of these Terms is found by a court of competent jurisdiction or arbitrator to be invalid, illegal, void, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms, all of which shall remain in full force and effect.
The parties agree that any invalid or unenforceable provision shall be replaced with a valid, enforceable provision that most closely approximates the intent and economic effect of the invalid or unenforceable provision.
20. Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Dewey's Pizza. A waiver of any breach or default shall not constitute a waiver of any subsequent breach or default.
21. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or agreements we publish on the Site, constitute the entire agreement between you and Dewey's Pizza with respect to your use of the Site and services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the same subject matter.
No oral or written information or advice given by any Dewey's Pizza representative shall create a warranty or in any way increase the scope of our obligations under these Terms unless expressly incorporated herein in writing.
22. Electronic Communications
By using our Site and services, you consent to receive electronic communications from us, including order confirmations, receipts, promotional offers, and other service-related communications. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
If you wish to opt out of promotional communications, you may do so by following the unsubscribe instructions contained in any promotional email or by contacting us directly at [email protected]. Please note that even after opting out of promotional communications, you may still receive transactional or service-related communications from us.
23. No Agency or Partnership
Nothing in these Terms shall be construed to create a partnership, joint venture, employment, franchise, or agency relationship between you and Dewey's Pizza. You do not have the authority to make any representations or commitments on behalf of Dewey's Pizza, and you agree not to purport to do so.
24. Assignment
You may not assign or transfer any of your rights or obligations under these Terms to any third party without our prior written consent. Any purported assignment in violation of this section shall be null and void. We may freely assign these Terms and any of our rights and obligations hereunder without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.

The section headings in these Terms are for convenience and organizational purposes only and shall not affect the interpretation or construction of these Terms. They do not constitute substantive limitations on the scope of any provision.
